Privacy Policy of the ŽDIS Mobile Application for External Users

The controller of the mobile application for external users of the Fisheries Data Information System (hereinafter – ŽDIS MOB APP) is the Fisheries Service under the Ministry of Agriculture of the Republic of Lithuania (hereinafter – the Fisheries Service), legal entity code 188752740, address: J. The ŽDIS MOB APP is intended for economic operators to complete fishery product sales notes, takeover declarations, transport documents, fishing logbooks, record fishing effort, and review fishing permits and certificates.

This Privacy Policy explains how the Fisheries Service processes information provided by data subjects (natural or legal persons, or their lawful representatives) when using the services available through the ŽDIS MOB APP.

The Fisheries Service processes only the personal data necessary and only to the extent required to achieve the purposes of the ŽDIS MOB APP. Personal data are processed in accordance with the principles of lawfulness, fairness and transparency, following Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (General Data Protection Regulation – GDPR), the Law on Legal Protection of Personal Data of the Republic of Lithuania, Order No. V1-33 of 17 January 2020 of the Director of the Fisheries Service “On the Implementation of the General Data Protection Regulation”, and other legal acts governing personal data protection.

Personal Data Processed in the ŽDIS MOB APP Database

The following personal data are processed in the ŽDIS MOB APP database (information provided directly by the data subject):

  • login details for the ŽDIS MOB APP (e-mail address and password);
  • location data (GPS geolocation data);
  • other data (operating system information, etc.) necessary to improve and ensure the smooth operation of the ŽDIS MOB APP.

Purposes and Legal Basis for Processing Personal Data

Personal data are processed for the following purposes:

  • based on the data subject’s consent (Article 6(1)(a) GDPR);
  • where processing is necessary for compliance with a legal obligation to which the Fisheries Service is subject (Article 6(1)(c) GDPR);
  • for the purposes of the legitimate interests pursued by the Fisheries Service (Article 6(1)(f) GDPR);
  • where processing is necessary for the establishment, exercise or defence of legal claims, or whenever courts are acting in their judicial capacity (Article 9(2)(f) GDPR).

Organisational and Technical Data Security Measures

The Fisheries Service may engage data processors for the processing of personal data. In such cases, appropriate measures are taken to ensure that data processors process personal data in compliance with applicable legal requirements.

To protect personal data, the Fisheries Service implements and maintains appropriate organisational and technical measures designed to safeguard personal data against accidental or unlawful destruction, alteration, disclosure, or any other unlawful processing. Access to personal data is protected, managed and controlled.

Personal data and other information provided during registration in the ŽDIS MOB APP are stored in the application database and retained no longer than required for the purposes of processing, applicable laws and other legal acts.

Disclosure of Personal Data to Third Parties

Personal data are disclosed to third parties only where required by law, for example upon a lawful request from state or municipal authorities, for the prevention of criminal offences, and in other cases provided for by legal acts.

Rights of Data Subjects

Data subjects have the right to:

  • know (be informed about) the processing of their own or represented person’s personal data;
  • access personal data being processed;
  • request the rectification of inaccurate personal data;
  • request the erasure of personal data (“right to be forgotten”);
  • restrict (suspend) the processing of personal data where at least one of the conditions established by law applies;
  • data portability;
  • object to the processing of personal data.

Where a data subject objects to the processing of personal data, the data subject acknowledges that the Fisheries Service may not be able to provide the requested services properly, as the requested personal data are necessary for the provision of such services.
